1. Acceptance of terms
These Terms of Service ("Terms") govern access to and use of CallOrb, an AI voice receptionist service operated by CallOrb, a product of Deebits ("CallOrb," "we," "us," "our"). By creating an account, configuring an assistant, or otherwise using CallOrb, you ("Customer," "you") agree to these Terms. If you are agreeing on behalf of a business, you represent that you have authority to bind that business.
2. The service
CallOrb provides an AI-powered voice assistant that can answer calls placed through a hosted call link, QR code, website widget, and (in a future phase) a forwarded phone number, using information the Customer provides (services, prices, hours, policies, and other "fact sheet" content). CallOrb transcribes conversations, may store audio and transcripts, and extracts lead information (such as name, phone number, and intent) which is delivered to the Customer.
3. AI disclosure & accuracy
CallOrb is an artificial intelligence system, not a human. It generates responses using an AI model and the information the Customer supplies. While designed to answer only from the Customer's fact sheet, the AI:
- May misunderstand a Caller, mishear audio, or generate an inaccurate, incomplete, or inappropriate response;
- May experience outages, delays, or connectivity issues beyond our control;
- Is not a substitute for professional advice (medical, legal, financial, or otherwise), and must not be configured or relied upon to provide such advice;
- Does not guarantee that any lead, transcript, or summary is complete or error-free.
Customers are responsible for reviewing their assistant's configuration, greeting, and fact sheet, for verifying leads before relying on them commercially, and for clearly disclosing to Callers that they are speaking with an AI, consistent with the built-in disclosure shown on the call page.
4. Accounts
You must provide accurate registration information and keep your credentials confidential. You are responsible for all activity under your account. Notify us promptly at hello@deebits.com of any unauthorized use.
5. Acceptable use
You agree not to use CallOrb to:
- Violate any applicable law, including telecommunications, consumer protection, call-recording/consent, or privacy laws in your jurisdiction;
- Configure the assistant to impersonate a real, specific human being, or to deceive Callers about the fundamental nature of the interaction beyond what the standard AI disclosure already covers;
- Collect sensitive personal information (health, financial account numbers, government IDs, etc.) from Callers unless you have an independent, lawful basis and adequate safeguards to do so;
- Send unsolicited communications, spam, or engage in telemarketing that violates applicable do-not-call or anti-spam rules;
- Send unlawful, harassing, defamatory, or fraudulent content through the service;
- Attempt to reverse-engineer, disrupt, or gain unauthorized access to the service, other accounts, or underlying AI models;
- Resell or white-label the service without our prior written consent.
6. Billing & trials
CallOrb is offered on the plans described at callorb.com/#pricing (Starter, Business, Pro, and custom Enterprise), each including a 14-day free trial with no credit card required unless stated otherwise at signup.
- Paid plans are billed monthly in advance in USD, based on the plan selected.
- Each plan includes a monthly allotment of answered minutes; usage beyond that allotment is billed at the applicable per-minute overage rate shown on the pricing page for your plan.
- You may upgrade, downgrade, or cancel at any time from the dashboard; changes take effect according to the billing cycle in effect at the time.
- Except as required by law or expressly stated otherwise, fees are non-refundable, including partial-month usage.
- We may suspend or limit service for accounts with failed or overdue payment after reasonable notice.
7. Data, recording & consent
Use of CallOrb is also governed by our Privacy Policy, which describes what caller audio, transcripts, lead data, and account data we collect and how it is used, stored, and shared with subprocessors including Google Gemini (AI processing), Resend, Twilio, and Telegram (notifications), and our hosting/database provider.
Where your jurisdiction requires consent to record or transcribe a call (including one-party or two/all-party consent regimes), you are responsible for ensuring your assistant's greeting and the platform's built-in AI/recording disclosure satisfy that requirement, and for obtaining any additional consent your business or local law requires.
8. Intellectual property
We retain all rights in the CallOrb software, models, orb interface, and related technology. You retain ownership of the content you upload (fact sheets, branding, business information). You grant us a license to use that content solely to operate and provide the service to you.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE (INCLUDING ANY AI-GENERATED OUTPUT, TRANSCRIPT, OR LEAD) WILL BE ACCURATE, UNINTERRUPTED, OR ERROR-FREE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CALLORB AND DEEBITS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE — INCLUDING ANY OUTPUT, RESPONSE, TRANSCRIPT, OR LEAD GENERATED BY THE AI — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow certain limitations of liability; in those jurisdictions, the above limitations apply to the fullest extent permitted by law.
11. Indemnification
You agree to indemnify and hold CallOrb and Deebits harmless from claims, damages, and expenses (including reasonable legal fees) arising from your use of the service in violation of these Terms or applicable law, including claims relating to your failure to obtain required call-recording or privacy consents from Callers.
12. Termination
You may cancel your account at any time from the dashboard. We may suspend or terminate access if you materially breach these Terms, fail to pay applicable fees, or use the service in a way that creates legal or security risk for us or others. Upon termination, your right to use the service ends; certain data may be retained or deleted in accordance with our Privacy Policy.
13. Governing law

14. Changes to these terms
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above and, where appropriate, by additional notice to Customers. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.
